Title IX at DSLCC

Title IX of the Education Amendments of 1972 (20 U.S.C. § 1681) is an all-encompassing federal law that prohibits discrimination based on the gender of students and employees of educational institutions which receive federal financial assistance.

TITLE IX COORDINATORS

In accordance with Title IX regulations, DSLCC has designated April Tolley, Director of Human Resources, as the Title IX Coordinator. She is charged with monitoring compliance with these regulations. Questions regarding Title IX, as well as concerns and complaints of non-compliance, may be directed to her. DSLCC has also designated Matt McGraw, Director of Student Services as Deputy Title IX Coordinator for Student Sexual Misconduct. He is responsible for receiving student complaints of sexual harassment, including sexual assault, sexual violence or other sexual misconduct.

DEFINITIONS

Sexual Misconduct: a violation of the values and behavioral expectations of the college that will not be tolerated. All reported violations within the jurisdiction of the college, including sexual assault and harassment, will be investigated and, as warranted, will be resolved through appropriate college disciplinary processes and/or criminal proceedings in accordance with applicable state and federal laws.

Sexual Assault: consists of physical contact of a sexual nature without consent. A sexual assault is defined as intercourse without consent, including rape (whether by acquaintance or stranger), sodomy, or other forms of sexual penetration. To constitute lack of consent, the acts must be committed either by force, threat of force, intimidation, or through use of victim's mental helplessness of which the accused was aware or should have been aware. Mental helplessness includes incapacitation by alcohol or other drugs. Sexual assault also includes intentionally touching, either directly or through clothing, of the victim's genitals, breast, thighs, or buttocks without the victim's consent, as well as touching or fondling of the accused by the victim when the victim is forced to do so against his or her will.

Verbal misconduct, without accompanying physical contact as described above, is not defined as sexual assault. Verbal misconduct may constitute sexual harassment, which is also prohibited under Dabney S. Lancaster Community College and VCCS regulations.

Sexual Harassment: Sexual harassment consists of unwelcome sexual advances, requests for sexual favors, or other verbal or physical conduct or written communication of a sexual nature which is intimidating, hostile or offensive, regardless of where such conduct might occur. Sexual harassment also shall be construed as repeated verbal, physical or written acts that may create a sexually uncomfortable atmosphere.

COMPLAINTS UNDER TITLE IX AT DABNEY S LANCASTER COMMUNITY COLLEGE

Students:
If you are a student who believes you have been or are the victim of sexual harassment, including sexual assault, sexual violence or other sexual misconduct, or any other form of gender discrimination under Title IX, you may report such misconduct or file a formal complaint under Title IX with the Deputy Title IX Coordinator for Student Sexual Misconduct.

Employees:
If you are an employee who believes you have been subjected to discrimination under Title IX, including sexual harassment, or who wishes to file a complaint under Title IX, you can do so with the Title IX Coordinator in the Human Resources Office. Complaints must be submitted in writing not more than 300 days after the incident(s) in question. For good cause and at Title IX Coordinator’s discretion, the writing requirement or the 300 day time limitation may be waived. Federal and state laws prohibit the taking of retaliatory measures against any individual who files a complaint in good faith.

The rights of both the accused and the complainant shall be protected, and the complainant's sexual history will be excluded in campus proceedings. The confidentiality of proceedings will be maintained to the fullest extent possible.
